In June of 2016, a woman called Miss Kelly was interviewed by an experienced community psychiatric nurse she wanted to take her own life. She refused to be detained by the Mental Health Act but agreed to an assessment of home treatment. The person who assessed her feared she was a danger to herself or others. She did not believe she was competent enough to consent.
The assessor then suggested that Miss Kelly should be detained against her wishes. Miss Kelly didn’t want to be in a facility, so she contacted Dr Ramanathan Elayaperumal, her psychiatrist. He was a Consultant Psychiatrist in the Home Treatment Team at Essex Partnership NHS Foundation Trust.
In response to the suggestion that was made, the Home Treatment Team performed a comprehensive evaluation on Miss Kelly’s current functioning and mental state. It also involved a detailed assessment of family and psychological therapy and a psychiatric diagnostic assessment.
According to the report, Miss Kelly was suffering from a variety of mental health issues, including the borderline personality disorder, bulimia, and anorexia. She also had an addiction history to drugs and had been a victim of domestic abuse. Stress, anxiety and depression caused her symptoms to worsen. She was also diagnosed with bipolar affective disorder as well as schizoaffective disorder.
Elayaperumal claims Medtronic discriminated against him intentionally due to his race or nationality. He argues that his low performance review in June 2000 and the failure to grant him certain assignments for projects were motivated by racism or national animus. However there is no evidence to suggest that Medtronic’s decisions were based upon those factors. Moreover, Elayaperumal’s lower performance review did not lead to an increase in his salary or benefits, or even his responsibilities.
